Hi everyone,
Thanks for all the comments and advice.
I'm pleased to report that I've now received the refund for the cost of the car, however it was not from the Car Dealer, but from my bank.
After yet another fruitless attempt to speak to someone in Blackburn & Darwen Trading Standards Office I eventually spoke to an anonymous person who stated that they do not take calls or speak to the public!
When I pushed the question of then "who does enforce the Consumers Rights Act in the Blackburn Area?" I was met with stony silence. If the Act is not enforced then it is meaningless.
I then made contact with my Bank to report the transaction as fraudulent and supplied all the proof that I had gathered and the upshot of the matter is that I now have my money back, and Lloyds Disputes and Fraud Department has now taken up the case to recover the money from this Car Dealer. Oh and I still have the Car!
I would love to be a fly on the wall when contact is made by Lloyds with this rouge dealer because he will discover that he's no longer going to be able to fob them off as he has done with me. I also believe that the bank has the power to sequest the monies from his bank account.
It couldn't happen to a nicer man!

Glad you're sorted and well done for taking the fight to them.
As to Blackburn council - I used to live in Manchester - and what North West (and other?) councils are reporting is that their central government budget cuts are so severe that they can't afford to do anything except their legal obligations. This means they'll do child and adult care and street services but no 'frills' such as enforcing the Consumer Rights Act.
Sadly the, "we don't take calls or speak to the public," policy is increasing.
 
Thank you all for your comments, regarding the sellers responsibility to take the car back, but unfortunately no one has told him!
Over the last few weeks I've had abusive replies to my telephone calls even slamming the phone down on me, the car trader flatly refuses to accept the return of the car.
I've now had to take legal advice and started a course of recorded letters informing him of my right to reject the car under the Consumers Rights Act 2015, but to no avail he's just totally ignoring his legal obligations.
It doesn't help when Blackburn and Darwen Trading Standards Office won't even reply to my request for their assistance.
If the authorities won't act when there is blatant abuse of consumers rights then Car Traders of this ilk, will take every advantage of the current situation we all find ourselves in.
I only wish I could name and shame him, but I've been advised not to as this may any effect any future legal action.
All I would say is that to check any car that is being offered for sale as thoroughly as possible and if in any doubt walk away.
I don't wish my circumstances on anyone.
Are you able to name the trader now you have your money back?
 
Very good news indeed and if you can keep the car this is great news they truly are great cars. There are unscrupulous sellers out there for all cars but also there are so some that go out of their way to help. Your just unlucky with this one hope you get to keep the car and if so I'm sure the forum will help you to work out why the engine is classed as 'blown' and hopefully fix it!

No, I've been told that I have to hold onto the car as the seller may ask for its return. What the Bank unfortunately didn't say was for how long. They're very wary about the situation as ownership can be disputed.
I'm going to give it a reasonable time then make a decision as to what to do with the car.

I know and it saddens me to own up that I had to buy another car very quickly, unfortunately not an A2 as there were none available within my price range at the time, especially as I had already paid not an inconsiderable amount out and was uncertain as to whether I would in fact get my money back. So (please don't shoot me) I bought a cheap, very cheap Renault Modus. The reasons for buying the A2 was because I had always hankered after one but I also I needed transport that I could use, as at the time I was classified Covid-19 vulnerable and was shielding. The whole situation had a marked effect on my ability to get around as public transport was out of the question. I will admit though the Modus has proved to be a great little car for what I needed it for and maybe some time in the future when things have settled into some form of normality I will again look for another A2.
 
I would be ensuring I knew the timelines and notice required to give the bank before you’re sure that you own it if you don’t hear otherwise.
 
Basically you do not own it. You need to ask the garage to collect it by a certain date or it will be disposed of.

Invoice the seller for storage fees at a reasonable rate but based on typical costs for such a service.

Send it to him as soon as possible so there is no dubiety about your intention to charge him for the service.

You are also allowed to earn, I think £1,000, from use of your home in this way tax-free so you wouldn’t even need to declare it if he does pay it.

Reasonably I think it might just light a fire under him to recover the car if he is going to do so - or to gift it to you if he isn’t.

Parkopedia or rent my drive are, I think, sites that give indications of cost for renting a driveway in an area. May be worth a look.

Hi everyone,
Well I've done everything I can to resolve this situation amicably with the dealer, but he's ignored all my efforts.
After taking professional advice, I sent a last letter asking him to remove the car from my home within a stated timescale or I would consider the car gifted. That time has well and truly elapsed and I've had no communication whatsoever from him so I'm now in a position where I need to get the car removed. It has been languishing on my drive since August and I now really need the space.
I could just scrap it but I thought someone in the club would maybe like the opportunity to take the car before I go down that route.
I am not looking to make a profit from this situation and the only costs that I've not been able to recover is the engineer's report that I had done to substantiate my initial claim, and the car recovery cost. If I can recoup £225, I would break even.
If any member is interested, please get in contact. The car would need to be trailered away as it is not roadworthy. I am located just outside Sc**thorpe.
